نظرية العصيان المدني

Is it disproportionate? Unconstitutional? Moral? Criminal? Current manifestations of civil disobedience are very controversial. But what really distinguishes civil disobedience? Do climate activists, farmer protesters, and citizens of the German Reich justify their actions in these terms? We urgently need a convincing and understandable theory about civil disobedience, which was presented by the distinguished legal researcher Samira Akbarian. The importance of civil disobedience to our democracy lies precisely in its risks: by exposing shortcomings in democratic processes, questioning the terms of participation, and reflecting the reality before us. Thus, breaking the law, as Samira Akbarian explains, can serve the fulfillment of democratic ideals. Therefore, we must question the idea that civil disobedience harms democracy and the rule of law. It is not a matter of justifying all forms of civil disobedience, but of learning to distinguish between its democratic and authoritarian expressions. Akbarian's thesis is that successful forms of civil disobedience must be understood as an “interpretation of the Constitution.” In her book, she elaborates on this surprising thesis and shows how civil disobedience enables direct democratic influence that can redress imbalances in political processes.
